| U.S. Computer Corporation, a Florida Corporation, having a principal place of business at 13553 66th St. N, Largo, FL, 33771 ("Manufacturer") warrants all new computers assembled by U.S. Computer Corporation (the "Product") as follows: | ||
| 1. Limited Warranty |
Manufacturer warrants that the Product sold hereunder will be free from defects in material and workmanship for a period of one (1) year from the date of purchase. If the Product does not conform to this Limited Warranty during the warranty period of one year, Buyer shall notify Manufacturer in writing or in person of the claimed defects and demonstrate to Manufacturer satisfaction that said defects are covered by this Limited Warranty. If the defects are properly reported to Manufacturer within the warranty period, and the defects are of such type and nature as to be covered by this warranty, Manufacturer shall, at its own expense, furnish and install replacement Product or, at Manufacturer's option, replacement parts for the defective Product. Such diagnosis, repair, and replacement shall be at the Manufacturer's designated facility. Buyer shall deliver and pick up all components of the Warranted Product to Manufacturer's site at Buyers expense. If Product is purchased via the Internet, Buyer shall pay freight to U.S. Computer and U.S. Computer will pay freight to return the product to Buyer. | |
| 2. Other Limits |
Manufacturer does not warrant defects
or damages arising from improper installation (where installation is by
persons other than Manufacturer), against defects in products or
components not installed by Manufacturer, or against damages resulting
from such non Manufacturer made products or components. Manufacturer does
not warrant damages or defects arising out of "Acts of God" such
as lightning, fire, storm damage, insect damage, etc. or
"Carelessness" such as liquid intrusions, abnormal temperature,
abnormal power, physical abuse, or other improper or abnormal use or
handling of the Product including use (1) in or upon a water going vessel
(2) use in equipment where Product is exposed to vibration, temperatures
above 100F or below 32F, or other exposure.
This warranty also does not apply to Product upon which repairs have been effected or attempted by persons other than Manufacturer. All repairs to Product must be made by Manufacturer or Manufacturer's designated agents or with Manufacturer's written consent. Breaking the warranty seal voids the Warranty. The Warranty on all computer software is from the software company creating the software and any and all software Warranty questions must be directed to said creator of the software. U.S. Computer Corporation assumes no responsibility for computer software manufactured by other parties. |

| 3. Exclusive Obligation | THIS WARRANTY IS EXCLUSIVE. The sole and exclusive obligation of Manufacturer shall be to repair or replace the defective Product in the manner and for the period provided above. Manufacturer shall not have any other obligation with respect to the Product or any part thereof, whether based on contract, tort, strict liability or otherwise. Under no circumstances, whether based on this Limited Warranty or otherwise, shall Manufacturer be liable for incidental, special, or consequential damages. | |
| 4. Other Statements |
U.S. Computer Corporation may, from time to time, offer Extended Maintenance at an additional fee or fees, which may extend provisions of this basic warranty. Manufacturer's employees or representatives' ORAL OR OTHER WRITTEN STATEMENTS DO NOT CONSTITUTE WARRANTIES, shall not be relied upon by Buyer, and are not a part of the contract for sale or this limited warranty. No employee of U.S. Computer Corporation has the authority to change or amend U.S. Computer Corporations warranty policies. |

| 5. Entire Obligation |
This Limited Warranty states
the entire obligation of Manufacturer with respect to the Product.
If any part of this Limited Warranty is determined to be void or illegal, the remainder shall remain in full force and effect. THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE. |
